The agreement
These terms are an agreement between you and xPerDay (“we”). By creating an account or using the app you accept them, together with our privacy policy.
Who can use xPerDay
You must be 16 or older. One account per person; keep your sign-in details to yourself. You are responsible for what happens under your account.
Not medical advice
xPerDay doesn’t diagnose, treat or prevent any condition, and it isn’t a substitute for a doctor, physiotherapist or other health professional.
Plans are built by fixed rules from what you tell the app. They can’t know everything about your body. Check with a health professional before starting if you are pregnant or recently postpartum, recovering from surgery or injury, have a heart condition, or have been told to avoid exercise. The safety check can switch on gentle mode, but it is not a medical assessment.
Move within what feels comfortable. Stop if you feel pain, dizziness, chest pain or shortness of breath, and seek help if it continues. You use the app at your own risk, within the limits the law allows.
Free, Plus and billing
xPerDay Free costs nothing and includes non-personalised ads. xPerDay Plus is an auto-renewing subscription, $6.99 a month or $44.99 a year in the US (local prices are set by the store), with a 7-day free trial for new subscribers.
- You buy, renew, cancel and request refunds through the App Store or Google Play, under their terms. We never see your card.
- The trial turns into a paid subscription unless you cancel at least 24 hours before it ends.
- Cancelling stops the next renewal; Plus stays on until the end of the period you paid for.
- If we change the price, the store tells you first and you can cancel before it applies.
Ads
The Free plan shows non-personalised ads from Google AdMob. Ads never appear during onboarding, the safety check, a session or the feedback questions. Plus has no ads. See the privacy policy for what AdMob processes.
Using xPerDay fairly
Don’t misuse the service: no attempts to break in, overload it, scrape it, reverse engineer it beyond what the law allows, or use it to break the law. The app, its movements, figures, text and design belong to us or our licensors; you get a personal, non-transferable licence to use the app while these terms apply.
Your content
What you create in xPerDay is yours: your routines, the programs you put together and your display name.
When you share a routine by link or publish a program, you give xPerDay a non-exclusive, worldwide, royalty-free licence to store, show and distribute it in the app and on xperday.com, for as long as it stays shared or published. Stop sharing a link or unpublish a program and the licence ends, except that people who already saved a copy or joined a program can keep using it.
- A shared link shows your routine’s name and practices, and your note only if you choose to include it. It never shows your name or account details.
- We review every program before it appears, and we may decline it or remove it later.
- What you write must not make health or medical claims, or include links or contact details. Keep it respectful and lawful, and only share what you have the right to share.
To report something, tap Report on it in the app, or email support@xperday.com to report it or ask us to take it down. We may remove content that breaks these terms, and we’ll tell the creator why where reasonable.
Ending your account
You can delete your account at any time in the app. How deletion works. Deleting your account doesn’t cancel a store subscription: cancel that in the App Store or Google Play.
We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where reasonable, we’ll tell you why first.
Changes
We may add, change or remove features. If we change these terms in a way that matters, we’ll tell you in the app before the change takes effect.
Liability
We work hard to keep xPerDay running and your data safe, but the service is provided “as is”. To the extent the law allows, we aren’t liable for indirect or consequential losses, and our total liability is limited to what you paid us in the 12 months before the claim.
Nothing in these terms limits rights you have that can’t be excluded by law, including under South Africa’s Consumer Protection Act, 2008, or the consumer laws of the country you live in.
Governing law
These terms are governed by the laws of the Republic of South Africa. If you live elsewhere as a consumer, you keep the protection of the mandatory laws of your country.
